Privacy Policy

Overview

Buskr helps people discover live performers, support artists, send tips, request songs, follow performers, and manage live performance activity. This policy explains the types of information Buskr may collect and how that information is used.

Information We Collect

We may collect account information such as your name, email address, phone number, profile details, user type, and authentication information when you create or use a Buskr account.

If you sign up for updates or ask to be notified about performers on this website, we collect the email address you provide for that purpose. You can unsubscribe at any time.

Performers may choose to add social media handles or artist links (such as Instagram, TikTok, YouTube, X, Facebook, Spotify, or Apple Music) to their profile. These are displayed publicly in the app and on the performer's public tipping page.

If you choose to make a voluntary contribution to Buskr ("Support Buskr"), the payment is processed by Stripe and goes to Buskr LLC. Buskr is not a charity; contributions are not tax-deductible and are non-refundable.

Buskr may collect precise (GPS-level) location only while you use map, discovery, or live performance features and with your permission; it is not collected in the background. Performers may choose to share performance location so nearby users can discover them. Precise geolocation is treated as sensitive personal information under California law.

If you add a profile photo, we access the specific image you select (or your camera, if you take a new one) to upload it; we do not scan your photo library. Profile photos are displayed publicly.

We collect financial and transaction data related to tips, payouts, platform fees, and (via Stripe) tax information such as amounts used to issue a 1099-K where required. We also collect app activity related to tips, song requests, follows, ratings, badges, performance status, notifications, and other features needed to operate the app.

Show attendance: when you join a live performance — automatically when you are at the only nearby live show, or by choosing one when several are nearby — we record which performance you are attending and when, so we can show that performer a live audience count. This attendance signal is stored on your profile and, like other profile information, may be visible to other signed-in users while you are attending; it is cleared when you leave or the set ends.

Payments

Buskr uses Stripe to process payments and performer onboarding. Buskr does not store full credit card numbers. Payment information is handled by Stripe according to Stripe's own terms and privacy practices.

How We Use Information

We use information to operate Buskr, show nearby live performers, process tips and requests, support performer accounts, prevent misuse, improve reliability, and provide customer support. When you join a live performance we use your show-attendance record to show that performer a live audience count while you are attending, clearing it when you leave or the set ends. With your permission we send push notifications, including alerts when performers you follow go live and when a performer goes live near your approximate location (you can turn nearby alerts off in the app's settings).

Analytics and Diagnostics

We use Google Analytics for Firebase and Firebase Crashlytics, which collect app-usage events (including when tips are sent and their amount, when performers go live, and when performers are followed), an app-instance identifier, device and operating-system information, and coarse location derived from IP address, to help us understand engagement and diagnose crashes. We use this information in aggregate and do not use it to build advertising profiles.

Service Providers & Sharing

We do not sell or rent your personal information. Buskr may use third-party services such as Firebase, Google Cloud, Apple services, and Stripe to provide authentication, hosting, data storage, notifications, analytics, payments, and app infrastructure. We may also share information to comply with legal requirements or protect our rights and safety, and in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of some or all of Buskr's assets, in which case your information may transfer to the successor entity subject to this Privacy Policy (or one at least as protective), and we will notify you of the transfer.

Data Security

We use reasonable technical and organizational measures to help protect information. No system is perfect, and we cannot guarantee absolute security.

Age Requirement

Buskr is intended only for adults 18 and older. We do not knowingly collect personal information from anyone under 18. If you believe someone under 18 has provided personal information, contact us so we can review and delete it.

Data Retention

We keep personal information only as long as needed to run the service, meet legal obligations, resolve disputes, and enforce our agreements. When you delete your account we delete or de-identify your personal information, with limited exceptions. First, to prevent abuse of our new-performer promotional fee waiver, we retain a one-way hashed (irreversible) value derived from your phone number and/or email. This value cannot be used to contact you or to reconstruct your phone or email, and is used solely to stop the same person from repeatedly claiming the promotion by deleting and recreating accounts. Second, we retain records of completed financial transactions (tips, platform fees, and instant payouts, including amounts, fees, and dates) for tax, accounting, dispute-resolution, and fraud-prevention purposes. Your identity is redacted from tip records you sent; remaining records are stored server-side, are never publicly visible, and are not used for any other purpose.

Your Rights & Choices

You can access, correct, or delete your information, and delete your account, from within the Buskr app (Settings), or by emailing us. Deletion is subject to the limited exceptions described in "Data Retention" above. You can control location and notification permissions in your device settings, and unsubscribe from performer alert emails using the link in each email. You may also request a copy of your data.

California Privacy Rights (CCPA/CPRA)

We do not sell your personal information and do not share it for cross-context behavioral advertising. California residents may request to know, access, delete, or correct their personal information, opt out of any sale or sharing, and limit the use of sensitive personal information (which for us can include precise geolocation and financial account information), without discrimination. To exercise these rights, email thebuskrapp@gmail.com or use the in-app controls.

We use sensitive personal information only as necessary to provide the Service (for example, precise location to show nearby performers, and financial account information to process payments and payouts) and do not use or disclose it for purposes that would require offering a separate right to limit that use.

You may use an authorized agent to submit a request on your behalf. We may require the agent to provide proof of your written permission and may ask you to verify your own identity directly with us before we act on the request. Residents of other U.S. states with comprehensive privacy laws may have similar rights, including the right to appeal a denial of a request; contact us at the address below and we will respond as required by applicable law.

Do Not Track

Some browsers transmit a "Do Not Track" (DNT) signal. Because there is no common industry standard for DNT, Buskr does not currently respond to DNT signals. We do not track you over time and across third-party websites, and we do not permit third parties to collect personal information about your activity across different websites when you use the Service.

Legal Basis for Processing

Where applicable law requires a legal basis to process your personal information, we rely on your consent, the performance of our contract with you, our legitimate interests in providing and improving the Service, and compliance with our legal obligations.

International Data Transfers

Buskr is operated in the United States. If you access the Service from outside the United States, your information may be transferred to, stored in, and processed in the United States or other countries. We take appropriate steps to protect your information consistent with this Privacy Policy.

Changes to This Policy

We may update this Privacy Policy from time to time. For material changes we will provide advance notice through the app or by email. Material changes apply prospectively; we will not use previously collected personal information in a materially different way that reduces its protection without your consent. The "Last updated" date above reflects the current version.
